PFAS in Product Safety Recalls: FDA Authority and Consumer Notification

PFAS Product Recalls: A Developing Regulatory Tool

While large-scale consumer product recalls for PFAS have been limited, FDA’s authority to mandate recalls or accept voluntary recalls for PFAS-contaminated food, cosmetics, and medical devices is an emerging regulatory tool with significant implications for consumer safety.

FDA Food Recall Authority and PFAS

FDA can mandate recalls of food products containing PFAS at concentrations posing public health risks under the Federal Food, Drug, and Cosmetic Act’s adulteration provisions. FDA and USDA coordinated fish consumption advisories—not formal recalls but functionally equivalent consumer protection actions—for PFAS-contaminated aquaculture products from affected growing areas.

Cosmetics and Personal Care Products

PFAS-containing cosmetics and personal care products have been subject to voluntary recalls by manufacturers responding to state disclosure requirements and consumer pressure. FDA’s expanded cosmetics oversight authority under the Modernization of Cosmetics Regulation Act (MoCRA) provides new tools for PFAS regulation in personal care products.

Medical Device PFAS Concerns

Medical devices containing fluoropolymer components—including catheters, tubing, and implantable materials—are regulated by FDA under device safety standards that predate PFAS concerns. Emerging research on PFAS migration from medical device materials into patients is prompting FDA review of extractables standards for fluoropolymer-containing devices.
